Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. by means of a clear statement, for example a letter sent by post or an email, of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive your notification of withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us, Himalaya Textilhandels GmbH, Röthbargweg 2b, 22145 Braak near Hamburg, Germany, without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the fourteen-day period has expired. We shall bear the cost of returning the goods.
You are only liable for any diminished value of the goods if this diminished value results from handling the goods in a way that is not necessary for checking their condition, properties and functionality.
(2) Exclusion of the Right of Withdrawal
We would like to point out that, pursuant to Section 312g para. 2 sentence 1 of the German Civil Code (BGB), a right of withdrawal does not exist, among other cases, for contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual choice or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer pursuant to Section 312g para. 2 sentence 1 no. 1 BGB. In the case of such contracts, you cannot withdraw from the contract. Section 312g para. 2 sentence 1 BGB provides for further cases in which there is no statutory right of withdrawal; however, these are not relevant to contracts concluded via this online shop.
